A. The parties to these Terms and Conditions are you, and the owner of this www.cgbookclub.com website, and CG Book Club. All references to “we”, “us”, “our”, this “website” or this “site” shall be construed to mean this website and/or representatives and officers of CG Book Club

B. We reserve the right to modify these Terms of Use at any time, and without prior notice, by posting an amended Terms of Use that is always accessible through the Terms of Use link on this site’s home page. You should scroll to the bottom of this page periodically to review material modifications and their effective dates. YOUR CONTINUED MEMBERSHIP IN CG BOOK CLUB AND USE OF THIS SITE FOLLOWING OUR POSTING OF A MODIFICATION NOTICE OR NEW TERMS OF USE ON THIS SITE WILL CONSTITUTE BINDING ACCEPTANCE OF THE MODIFICATION OR NEW TERMS OF USE.

C. By being a member of CG Book Club you agree that you will:

(1) Have fun!;
(2) Abide by the rules of CG Book Club;
(3) Cooperate with any investigation conducted by the International Federaltion of Officially Recognized Book Clubs; and
(4) NOT to use any CLIFF notes or movie versions of books that have been selected to be read.

II. Privacy Statement:


By attending meeting of CG Book Club you consent to allow pictures of the event that include you to be posted on the club's website.

In other areas, We are committed to protecting your privacy. Authorized representatives of the book club on a need to know basis only use any information collected from individual members. We constantly review our systems and data to ensure the best possible service to our members.

III. Confidentiality:


Member records are regarded as confidential and therefore will not be divulged to any third party, other than if legally required to do so to the appropriate authorities. Members have the right to request sight of, and copies of any Member Records we keep, on the proviso that we are given reasonable notice of such a request. Members are requested to retain copies of any literature issued in relation to the provision of our services. Where appropriate, we shall issue Member's with appropriate written information, handouts or copies of records as part of an agreed contract, for the benefit of both parties.

IV. Disclaimer:


The information on this web site is provided on an "as is" basis. To the fullest extent permitted by law, this Book Club:

excludes all representations and warranties relating to this website and its contents or which is or may be provided by any affiliates or any other third party, including in relation to any inaccuracies or omissions in this website and/or the Book Club’s literature; and

excludes all liability for damages arising out of or in connection with your use of this website. This includes, without limitation, direct loss, loss of business or profits (whether or not the loss of such profits was foreseeable, arose in the normal course of things or you have advised this Book Club of the possibility of such potential loss), damage caused to your computer, computer software, systems and programs and the data thereon or any other direct or indirect, consequential and incidental damages.

V. Arbitration:


Except for actions to protect intellectual property rights and to enforce an arbitrator’s decision hereunder, all disputes, controversies, or claims arising out of or relating to this Agreement or a breach thereof shall be submitted to and finally resolved by arbitration under the rules of the American Arbitration Association (“AAA”) then in effect. There shall be one arbitrator, and such arbitrator shall be chosen by mutual agreement of the parties in accordance with AAA rules. The arbitration shall take place in Tyler, Texas, USA, and may be conducted by telephone or online. The arbitrator shall apply the laws of the State of Texas, USA to all issues in dispute. The controversy or claim shall be arbitrated on an individual basis, and shall not be consolidated in any arbitration with any claim or controversy of any other party. The findings of the arbitrator shall be final and binding on the parties, and may be entered in any court of competent jurisdiction for enforcement. Enforcements of any award or judgment shall be governed by the United Nations Convention on the Recognition and Enforcement of Foreign Arbitral Awards. Should either party file an action contrary to this provision, the other party may recover attorney’s fees and costs up to $1,000.00.

VI. Jurisdiction And Venue


The courts of Smith County in the State of Texas, USA and the nearest U.S. District Court in the State of Texas shall be the exclusive jurisdiction and venue for all legal proceedings that are not arbitrated under these Terms of Use.

VII. Controlling Law


This Agreement shall be construed under the laws of the State of Texas, USA, excluding rules regarding conflicts of law. The application the United Nations Convention of Contracts for the International Sale of Goods is expressly excluded.
